By using the ETERNAL HEADSTONES website or purchasing our products and services, you agree to abide by the following Terms & Conditions. These terms may be updated periodically, and continued use of our services constitutes acceptance of any changes. The latest version is always available at ETERNAL HEADSTONES.


2. Order Placement & Payment

  • You must be at least 18 years old to place an order.
  • ETERNAL HEADSTONES reserves the right to accept or reject any order.
  • Payment must be valid and authorized at the time of purchase.
  • You are responsible for all applicable taxes and shipping fees.
  • If payment is not received, you agree to pay all outstanding amounts upon demand.


3. Pricing & Shipping

  • Prices are subject to change without notice.
  • Standard shipping is free within the lower 48 states; additional charges apply for Alaska and Hawaii.
  • Expedited shipping may be available for an additional fee.
  • Shipping delays due to weather, labor shortages, or other uncontrollable circumstances are not the responsibility of ETERNAL HEADSTONES.
  • If shipping directly to a cemetery, you must verify that the address is correct and the cemetery is prepared to receive the delivery.
  • ETERNAL HEADSTONES carriers provide curbside delivery only; moving and installation are the customer’s responsibility.


4. Delivery Issues & Address Changes

  • If an order is undeliverable and returned to ETERNAL HEADSTONES, you will be responsible for a re-delivery fee.
  • Address changes:
    • Before shipping: No fee.
    • In transit: $15 fee.
    • Near destination: Fees vary based on location and delivery type.


5. Cancellation, Refunds & Returns

  • Orders can be canceled within one business day for a full refund unless rush services were requested.
  • Cancellations within two business days incur fees based on order value:
    • Orders under $500: 10% cancellation fee
    • Orders $501-$1,000: 7.5% cancellation fee
    • Orders over $1,001: 5% cancellation fee
  • Orders cannot be canceled after three business days.
  • Damaged items must be reported within 24 hours for a free replacement.
  • Incorrect engraving due to ETERNAL HEADSTONES error will be corrected at no charge.


6. Layout Changes

  • Revisions before engraving incur an administrative fee:
    • Stones 24x12 or smaller: $29
    • Stones 28x16 and custom sizes: $39
    • Upright stones: $59


7. Product Availability & Materials

  • ETERNAL HEADSTONES does not guarantee stock availability.
  • Natural stone products vary in color, texture, and veining; these are not defects and will not be refunded or replaced.
  • Engraved stones may change in appearance due to environmental exposure.


8. Installation Responsibility

  • ETERNAL HEADSTONES does not install headstones or markers.
  • Vertical placement of flat markers is not recommended and may result in damage.
  • ETERNAL HEADSTONES is not liable for damage, injury, or loss caused by improper installation.


9. Engraving & Custom Orders

  • Customers must verify all submitted text and design details before placing an order.
  • Engraving is performed as submitted; ETERNAL HEADSTONES is not responsible for customer errors.
  • Inappropriate or offensive content will not be accepted.


10. Porcelain Memorial Photos

  • ETERNAL HEADSTONES offers porcelain memorial photos through a third-party supplier.
  • Warranty claims for breakage or deterioration are handled directly through the supplier.


11. Intellectual Property

  • Customers must have legal rights to any text or designs submitted for engraving.
  • ETERNAL HEADSTONES reserves the right to reject orders containing infringing or unauthorized content.


12. Disclaimer of Warranties & Limitation of Liability

  • ETERNAL HEADSTONES disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.
  • ETERNAL HEADSTONES is not liable for indirect, special, incidental, or consequential damages.
  • Liability is limited to reimbursement of payments made under this agreement.


13. Indemnification

Customers agree to indemnify and hold harmless ETERNAL HEADSTONES and its employees from any claims, losses, or damages resulting from:

  • Violation of these Terms & Conditions.
  • Misuse of ETERNAL HEADSTONES products or services.
  • Intellectual property disputes related to custom orders.


14. Legal Terms

  • Force Majeure: ETERNAL HEADSTONES is not responsible for delays caused by events beyond its control (e.g., natural disasters, supply chain issues, labor strikes).
  • Governing Law & Venue: This agreement is governed by California law. Legal disputes will be resolved in **San Joaquin County, **California
  • Attorney’s Fees: The prevailing party in any legal dispute may recover reasonable attorney’s fees.


15. SMS Communications

ETERNAL HEADSTONES provides SMS messaging services for updates, promotions, and order notifications. By opting in, you agree to:

  • Receive text messages (message frequency varies).
  • Opt out at any time by replying STOP.
  • Possible carrier message and data rates.
  • No liability for message delays or undelivered texts.

Data Collection & Privacy

  • ETERNAL HEADSTONES collects phone numbers and engagement data for SMS services.
  • No personal information is sold or shared with third parties for marketing.
  • Data is securely stored and retained only as long as necessary.
